Split Decision
I wonder why the Supreme Court denied cert in the Kachalsky case. As this article states, and I observed myself, they are a bit split at the Circuit Court level. They will have to address this eventually.
I'm thinking that the Supremes might be waiting for 2 things to happen. A) The Illinois Court case and B) Upcoming Legislation.
The problem with Kalalchsky was that they went after a State that DOES issue Some CHPs. Wherein, there's Bupkiss in Illinois, and they need to either file for the Supreme Court to overturn their Federal ruling, or come up with some more Freedom.
Now, the current makeup Supremes have stated that they hate to get involved with something that is in front of the Congress until it gets signed into Law. So whatever way the Congress decides to screw us, we have to be patient.
But you're correct that they can't keeping Ducking the 2A Rights issue forever.
